By participating in this promotion, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.
- Sponsor. This promotion is sponsored by Agilent Technologies, Inc., 5301 Stevens Creek Boulevard, Santa Clara, California USA 95051 (“Agilent”) under promotion code 3360.
- Promotion Period. This promotion begins on May 6, 2026, at 8:00 am PST and ends on July 28, 2026 at 11:59 pm PST (“Promotion Period”). All entries must be received before the Promotion Period ends.
- Promotion Description/Eligibility. a. No purchase necessary. b. This promotion is limited to specific countries and is only open to entrants who, at the time of submission, are legal residents of, and physically located within, Austria, Canada (excluding the Province of Quebec), China, Denmark, Finland, France, Germany, India (excluding State of Tamil Nadu), Japan, South Korea (Republic of), Netherlands, New Zealand, Poland, South Africa, Spain, Switzerland, Taiwan, United Kingdom, and the United States. Entrants must be at least eighteen (18) years of age or the age of majority in their jurisdiction of residence (whichever is higher) at the time of submission. c. Government agencies and institutions (including public universities), and their employees, are not eligible to participate or receive prizes, nor are individuals who appear on the U.S. Government Department of Treasury’s Specially Designated Nationals List. Employees of Agilent, its affiliates, subsidiaries, authorized distributors, and agents, and immediate family members of each, are not eligible. Individuals who provide or that are employed by an organization that provides healthcare related services or are involved in decisions to purchase, lease, recommend, use, or prescribe medical services and IVD products (healthcare professionals) are not eligible to win a prize. d. This promotion is void where prohibited by law.
- Business Entity Entries. a. Entries may be submitted by a business entity (“Business Entrant”). In the event of an entry by a Business Entrant, the individual submitting the entry on behalf of such Business Entrant (“Authorized Representative”) represents and warrants that: (i) the Authorized Representative is a duly authorized employee, officer, or agent of the Business Entrant with full power and authority to enter this promotion and bind the Business Entrant to these Official Rules; (ii) the Business Entrant is a duly organized legal entity in good standing under the laws of its jurisdiction of organization; (iii) the Business Entrant satisfies all eligibility requirements set forth in these Official Rules to the extent applicable to business entities; and (iv) the Authorized Representative personally satisfies all applicable individual eligibility requirements, including age and residency requirements. b. For the avoidance of doubt, a Business Entrant may not be a government agency or institution, and may not be Agilent, or any affiliate, subsidiary, authorized distributor, or agent of Agilent. If the Business Entrant is selected as a winner, the prize will be awarded in the name of the Business Entrant, and the Business Entrant shall be solely responsible for any tax or legal obligations arising therefrom.
- How to Enter. a. Visit www.agilent.com during the Promotion Period and follow the instructions to complete and submit the entry form. Entries will be collected at the end of the online survey that were submitted during the promotion period. b. All entries become the property of Agilent and will not be acknowledged or returned. By entering, the entrant hereby assigns to Agilent all intellectual property rights in their entries, including copyrights, to Agilent. c. Limit one (1) entry per person. Incomplete and/or incoherent entries are void and no mechanically reproduced, software-generated, or other automated multiple entries are permitted. d. Agilent, in its sole, reasonable discretion, reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of this promotion. e. All entrant information, including e-mail addresses, is subject to Agilent’s Privacy Statement, which can be found at www.agilent.com/go/privacy .
- Prize Description. a. There will be one prize winner]. The prize is s choice of a smart watch valued at approximately $300.00 USD, a tablet valued at approximately $300.00 USD, or headset valued at approximately $300.00 USD. b. The total approximate retail value of the prize is $300.00 USD. c. Agilent reserves the right to substitute a prize of equal or greater value in the event, that the stated prize becomes unavailable. Except for applicable manufacturer’s standard warranties, the prize is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. d. Agilent reserves the right to withhold the distribution of any prize if such distribution is prohibited by any applicable laws, rules, or regulations. In such cases, Agilent will comply with all legal requirements and notify the affected participant(s) accordingly.
- Taxes. All federal, state, and/or local income and other taxes and duties, if any, are the winner's sole responsibility.
- Odds of Winning. The odds of winning this promotion depend on the number of eligible entries received.
- Winner Selection. A random drawing will be conducted by Agilent on or about August 1, 2026, to select one potential winner from among all eligible entries received during the Promotion Period. Previous winners of the Agilent Web Survey Sweepstakes are eligible to win in this Sweepstakes.
- Winner Notification. Any potential winner will be notified by mail, email, and/or telephone, using the details provided with entry. If a potential winner cannot be contacted, does not respond within fourteen (14) days from the date that Agilent first tries to notify him/her, and/or the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to win the promotion or receive the prize, and an alternate potential winner will be selected. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the promotion, including, without limitation, where permitted by law, the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared a "winner" of the promotion. In accordance with local laws, if the selected entrant is a Canadian or South African resident, that entrant will be required to answer a mathematical skill-testing question, without assistance of any kind (whether mechanical or otherwise), within the time frame provided above. Agilent assumes no responsibility for lost, late, or misdirected communications or any computer, online, telephone, or technical malfunctions that may occur. No substitution, transfer, or assignment of the prize is permitted, except that Agilent reserves the right to substitute a prize of equivalent value in the event the offered prize is unavailable.
- General Conditions. Entrants agree to abide by the terms of these official rules and by the decisions of Agilent, which are final and binding on all matters pertaining to this promotion. EACH ENTRANT AGREES THAT ANY DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION OR ANY PRIZE AWARDED WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF CALIFORNIA OR THE APPROPRIATE STATE COURT LOCATED IN SANTA CLARA, CALIFORNIA, USA. THESE OFFICIAL RULES ARE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA, USA, WITHOUT REGARD TO CHOICE OF LAW OR CONFLICT OF LAW RULES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. All federal, state, and local laws and regulations apply. Acceptance of a prize constitutes permission for Agilent to use winners' names and likenesses for advertising and promotional purposes without additional compensation, unless prohibited by law. Agilent takes no position on whether the selected entrant’s acceptance of the prize is in compliance with entrant’s employer’s policies or other guidelines, rules, laws, or regulations to which the selected entrant may be subject.
- Indemnification and Limitation of Liability. By entering the promotion or accepting any prize or item, each entrant expressly agrees to indemnify, defend, and hold harmless, and does hereby forever waive, release, discharge, and covenant not to sue Agilent and its past and present parents, subsidiaries, and affiliates, and each of their respective past and present partners, limited partners, owners, entity owners, members, managers, employees, agents, attorneys, contractors, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, directors, officers, shareholders, successors, assigns, and insurers (collectively, “Released Parties”), for and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions, and causes of action whatsoever, of every nature, character and description, whether known or unknown (collectively, “Claims”), including, but not limited to, all those arising out of or in any way related to (a) the promotion; (b) these Official Rules (including the legality or enforceability of these Official Rules or any portion hereof); (c) entrant’s entry into and/or eligibility for the promotion; (d) any participation in the promotion; (e) the negligence of any of the Released Parties; (f) any prize (including without limitation the receipt, non-receipt, delivery, misdelivery, expiration, acceptance, rejection, possession, defect, misuse or use of any prize, and any expenses incurred to utilize any prize); and (g) any presence at any promotion-related or prize-related activity or venue (if applicable), including, without limitation, Claims related to rights of publicity or privacy, defamation, or portrayal in a false light, whether intentional or unintentional, and whether asserted under a theory of contract, tort (including negligence), warranty or other theory. Each entrant represents and warrants that he or she owns and/or has the authority to release the Claims stated herein and expressly waives Section 1542 of the California Civil Code, which provides:
- Internet. If for any reason the Internet portion of the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Agilent or its third-party providers that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, Agilent reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the promotion, and to disqualify any individual who tampers with the entry process. Agilent assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, or destruction, or unauthorized access to, or alteration of, entries. Agilent is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, or software, or for failure of any e-mail or entry to be received by Agilent on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this promotion.
- Entry Content and Additional Entry Requirements.
a. Entries Submitted: “Entry” means each entry that an entrant submits to Agilent through the promotion, and includes the entry’s text, graphics, photos, sounds, music, videos, audiovisual combinations, and other materials.
b. Ownership; Rights Granted; No Confidentiality: The entrants submitting each Entry affirm, represent, and warrant that they own all rights in the Entry and assign to Agilent sole ownership of all right, title, and interest and intellectual property rights, including patent, trademark, trade secret, copyright, or other proprietary rights in and to the Entry. Entrants shall be solely responsible for each Entry and the consequences of submitting the Entry to Agilent through this promotion, including those which may result from later publication of the Entry by Agilent. Entrants further agree that each Entry submitted to Agilent does not contain any third-party owned materials, including copyrighted material or material that is subject to other third-party proprietary rights, unless entrants have permission from the rightful owner of the material or entrants are otherwise legally entitled to submit the material and to grant Agilent all of the rights granted herein. Entrants realize that Agilent may have access to, or may independently create content, product improvements, and material similar or identical to the information provided in each Entry, and entrants agree that they will not be entitled to any compensation by reason of the use by Agilent of such similar or identical material. Entrants understand and agree that each Entry submitted to Agilent will not be treated as confidential, and entrants agree not to include or disclose any trade secrets or other confidential or proprietary information as part of each Entry.
c. Scope of Assignment and Use Rights: Without limiting the generality of the foregoing, entrants acknowledge and agree that Agilent will own all rights to use, modify, reproduce, publish, perform, display, distribute, make derivative works of and otherwise commercially and noncommercially exploit each Entry in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to the applicable entrants or any other person or entity.
d. Entry Standards and Prohibited Material: Each Entry must comply with these Official Rules and the following requirements.
i. Entries cannot be sexually explicit or suggestive, unnecessarily violent, profane or pornographic, contain nudity, or include any materially dangerous activity.
ii. Entries cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), or any activities that may appear unsafe or dangerous.
iii. Entries cannot be derogatory of any ethnic, racial, gender, religious, professional, or age group. iv. Entries cannot be obscene or offensive, or endorse any form of hate or hate group. v. Entries cannot defame, misrepresent, or contain disparaging remarks about Agilent or its products, or other people, products, or companies. vi. Entries cannot infringe trademarks, logos, or trade dress owned by others, or advertise or promote any brand or product of any kind (other than Agilent’s brands/products), without permission. vii. Entries cannot include any personal identification, such as license plate numbers, personal names, e-mail addresses, or street addresses. viii. Entries cannot infringe on copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies, or other media) without permission; Agilent does not permit the infringement of others’ rights and any use of materials not original to the entrant (except copyrighted materials owned by Agilent) is grounds for disqualification from the promotion. ix. No background artwork should appear in an Entry unless it is an original work of the entrant. Any artwork, murals, etc. that can be seen in an Entry must be created solely by the entrant, or the entrant must be the sole owner of all copyright interests therein. x. Entries cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission. xi. Entries cannot communicate messages or images inconsistent with the positive images and/or goodwill with which Agilent wishes to associate (as determined by Agilent in its sole discretion). xii.
